Ambiguities remain around Prior vs Informed consent; the Government places an emphasis on informed consent whereas the ICO appears to be leaning towards prior. Despite these differences both parties give assurance that they are aligned. The approach for the industry has to be to prepare for both scenarios and so collaborative effort will be going into ensuring this is achieved.

Discussions are in progress on how Informed consent is best achieved and Your Online Choices (www.youronlinechoices.com) is currently viewed as the benchmark/model to work to.

In addition, a Technical Steering Group will be set up to identify solutions and areas where common approaches can be adopted.

Networks have also carried out their own audits on cookie use and details have been submitted to the IAB who are collating the overall picture which will influence future progress around the issues. All websites using cookies are strongly advised to carry out audits and formulate policies as to how the EU Directive is being addressed.
